In accordance with the (KVKK) Law on the Protection of Personal Data No. 6698 ("PERSONAL DATA PROTECTION LAW Law"), any information that identifies or can identify your identity, including your personal data and special categories of personal data, may be processed by Balonevi Sanayi ve Ticaret Anonim Şirketi ("Company") as the data controller.
The processing of personal data refers to any operation performed on data, such as obtaining, recording, storing, preserving, modifying, reorganizing, disclosing, transferring, classifying, or preventing the use of personal data.
The protection of your personal data is of vital importance to us. We want to assure you that we will take all necessary measures and remain fully transparent in this matter.
1.Which Personal Data Do We Process?
Name and surname, Date of birth, Email address, Contact address, Registered email address (KEP), Phone number, Invoice, promissory note, and check information, Order information, Request information, Website entry and exit information, Password and passcode information, Purchase history information, Cookie records, Information obtained through promotional activities.
2. Purposes of Processing Personal Data
The personal data collected may be processed for the following purposes: ensuring the legal and commercial security of our company and the individuals in a business relationship with our company; conducting satisfaction evaluation activities for our current customers; tracking requests and complaints; managing loyalty processes related to the company, products, and services; handling and following legal affairs; conducting training activities; managing organization and event activities; executing sales, marketing, purchasing, and post-sales support processes; carrying out finance and accounting transactions; managing processes related to promotion, advertising, campaigns, offers, promotions, announcements, celebrations, surveys, sweepstakes, competitions, and sending e-newsletters; conducting marketing and analysis studies; executing business operations; managing communication activities; carrying out sponsorship activities; conducting strategic planning activities; tracking requests/complaints; ensuring the security of movable property and resources; managing supply chain processes; conducting internal audit processes; carrying out occupational health and safety activities; fulfilling the obligation to notify relevant/authorized public institutions (such as Courts, Ministry of Finance, Ministry of Labor and Social Security, Ministry of Interior, etc.); ensuring the implementation of our company’s human resources policies; managing information and physical security processes; conducting storage and archiving activities; and ensuring that our company's activities are carried out in compliance with the legislation.
3. Transfer of Your Personal Data
For the purposes mentioned above, your data may be shared with our business partners, suppliers, affiliates, legally authorized public institutions, and private individuals both domestically and internationally, as required by legal obligations arising from regulations such as Turkish Commercial Code, Tax Procedure Law, Social Security Institution Law, Labor Law, Occupational Health and Safety Law, Vocational Qualifications Authority Law, Occupational Health Physician Regulation. This also includes authorized public institutions and organizations, intermediary financial institutions for assessing financial risks, independent audit firms for conducting audit processes, intermediary educational institutions providing professional training services, business partners, shareholders, real persons or legal entities under private law, suppliers, authorized public institutions and organizations, and local/international organizations that support our business processes, all within the legal framework and your consent, in accordance with the conditions and purposes of personal data processing specified in Articles 8 and 9 of the Personal Data Protection Law.
4. Method and Legal Basis for Collecting Your Personal Data
Your personal data is collected by our Company based on the legal reasons mentioned in Sections 2 and 3 above, either by obtaining your explicit consent or, where explicit consent is not required under Personal Data Protection Law, in a manner that does not infringe upon your fundamental rights and freedoms, and only to the extent necessary within our legitimate interests, and limited to the purpose for which it is processed, connected, and proportionate.
In this process, your personal data is collected through electronic methods in digital environments and on paper in physical environments. In the context of conducting commercial activities, personal data may be collected through written documents/forms such as order forms, customer information forms, return forms, supplier information forms, contact information forms, purchase request forms, current account opening forms, other commercial documents, payment information, valuable documents, candidate application forms, complaint/request/contact forms, assignment and inventory forms, as well as through notifications you make either orally, in writing, or electronically. This can be done either fully or partially automatically, or as part of any non-automatic data recording system, and may be obtained from both domestic and international affiliates, shareholders, collaborating program partner institutions and organizations, official institutions, and other third parties, including those outside of Balonevi Sanayi ve Ticaret Anonim Şirketi.
Personal data collected through these methods may be processed and transferred in accordance with the conditions and purposes of personal data processing specified in Articles 5 and 6 of Personal Data Protection Law, and for the purposes specified in Sections 2 and 3 of this document.
5. Your Rights Listed in Article 11 of the Personal Data Protection Law
As data subjects, if you submit your requests regarding your rights using the methods specified below in this Disclosure Text, our Company will respond to your request as soon as possible and within a maximum of 30 days free of charge, depending on the nature of the request. However, if the Personal Data Protection Board prescribes a fee, the fee determined by our Company will be charged.
In this context, you have the following rights regarding your personal data:
a)To learn whether your personal data is being processed,
b) To request information about your personal data if it has been processed,
c) To learn the purpose of processing your personal data and whether it is being used in accordance with that purpose,
ç) To know the third parties to whom your personal data has been transferred, whether domestically or internationally,
d) To request correction of your personal data if it is incomplete or inaccurate and to request that the correction be notified to the third parties to whom the data has been transferred,
e) To request the deletion or destruction of your personal data if the reasons necessitating processing no longer exist, even if it has been processed in accordance with the PERSONAL DATA PROTECTİON LAWK and other relevant laws, and to request that this action be notified to the third parties to whom the data has been transferred,
f) To object to any result that is produced against you as a result of the exclusively automated processing of your data,
g) To request compensation for damages if you suffer any harm due to unlawful processing of your personal data.
6. Data Controller and Methods for Requesting Information
In accordance with Article 13 of the PERSONAL DATA PROTECTİON LAW, you can submit your request to exercise the rights mentioned above to our Company using written or other methods specified by the Personal Data Protection Board through the channels listed below. In this context, for written applications you make under Article 11 of the Personal Data Protection Law, the channels and procedures for submitting your application are as follows:
As a data subject, to request the exercise of your rights specified under Article 11 of the Personal Data Protection Law, you should include explanations related to the right you are requesting.
